Welcome to SIM HOUSE CLUB ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at https://book.simhouseclub.com/, our booking platform, our simulator and facility services, and related communications (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Credentials

You are responsible for keeping your account credentials, access codes, and any keycards or PINs confidential. You are responsible for activity that occurs under your account or access credentials. Notify us immediately at hello@connectme2.io if you suspect unauthorized use.

3. Bookings, Payments, and Cancellations

Reservations are confirmed when payment is successfully processed. Taxes and service fees may apply. Cancellation, rescheduling, and refund policies are presented at checkout and may vary by session type and time. Chargebacks or payment disputes may result in suspension of your account.

4. Acceptable Use

You agree not to: (a) misuse, tamper with, or damage the facility or equipment; (b) share access credentials or allow unauthorized persons into the facility; (c) use the Service for any unlawful purpose; (d) harass other guests or staff; or (e) attempt to circumvent security or access controls.

9. Intellectual Property

The Service and its content, including text, graphics, logos, and software, are owned by SIM HOUSE CLUB or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

10. Reviews and Feedback

If you submit reviews, comments, or suggestions ("Feedback"), you grant SIM HOUSE CLUB a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish the Feedback in connection with the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SIM HOUSE CLUB AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless SIM HOUSE CLUB from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted at https://book.simhouseclub.com/terms with an updated "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for conduct that we reasonably believe is harmful to us, other users, or third parties.

16. Governing Law and Venue

These Terms are governed by the laws of the jurisdiction in which SIM HOUSE CLUB is organized, without regard to its conflict of laws rules. Any dispute arising from these Terms will be brought exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.
